• Not be prohibited from using the Services under applicable laws

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. Services Provided

5.2 For Schools

• Teacher recruitment services
• Candidate screening and verification
• Staff training and development
• Educational consulting
• Partnership programs

5.3 Service Limitations

We act as an intermediary connecting schools and teachers. We do not guarantee:

• Successful job placements or hiring
• Specific salary or compensation outcomes
• Continued employment or engagement
• Specific results from training programs

6. Fees and Payments

6.1 Service Fees

For Teachers: Job placement services are free. Training and certification programs have associated fees as disclosed on the Platform.

For Schools: Recruitment services are charged on a per-placement basis or through partnership agreements.

6.2 Payment Terms

• All fees are in Indian Rupees (INR) unless otherwise stated
• Payment must be made through approved payment methods
• Fees are non-refundable except as expressly stated
• We reserve the right to change fees with reasonable notice

6.3 Refund Policy

Training Programs: Full refund if cancelled 7 days before program start; 50% refund if cancelled 3-7 days before; no refund within 3 days of start.

Recruitment Services: Refund terms are specified in individual service agreements.

7. User Conduct and Responsibilities

7.1 Prohibited Activities

You agree NOT to:

• Provide false or misleading information
• Impersonate any person or entity
• Use the Platform for illegal purposes
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt unauthorized access to systems
• Scrape, harvest, or collect user data
• Interfere with Platform operations
• Engage in fraudulent activities
• Harass, abuse, or harm other users
• Post inappropriate or offensive content

7.2 Professional Conduct

Teachers: Must provide accurate credentials, honor commitments, and maintain professional standards.

Schools: Must provide truthful job information, honor employment terms, and treat candidates fairly.

8. Intellectual Property

8.1 Our Content

All content on the Platform, including text, graphics, logos, images, software, and training materials, is owned by SAIRA ACAD or licensed to us and is protected by copyright, trademark, and other laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for personal or internal business purposes. You may not:

• Reproduce, distribute, or modify our content
• Create derivative works
• Use content for commercial purposes without permission
• Remove copyright or proprietary notices

8.3 User Content

By submitting content (resumes, job postings, etc.), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content for providing our Services.

9. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy. We are committed to protecting your personal information and complying with applicable data protection laws.

10. Disclaimers and Limitations of Liability

10.1 Service Disclaimer

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Accuracy or completeness of information
• Uninterrupted or error-free operation
• Security of data transmission

10.2 Third-Party Verification

While we conduct reasonable screening, we do not guarantee the accuracy of information provided by users. Schools should conduct their own verification of teachers' credentials, and teachers should verify job details independently.

10.3 Limitation of Liability

To the maximum extent permitted by law, SAIRA ACAD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Employment-related disputes
• Unsuccessful placements or hirings
• Third-party actions or conduct

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim, or ₹10,000, whichever is less.

11. Indemnification

You agree to indemnify and hold harmless SAIRA ACAD, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of third-party rights
• Any content you submit or share

12. Termination

12.1 By You

You may terminate your account at any time by contacting us or using account settings. Termination does not relieve you of payment obligations for services already rendered.

12.2 By Us

We may suspend or terminate your access immediately, without notice, for:

• Fraudulent or illegal activities
• Non-payment of fees
• Abuse of the Platform

12.3 Effect of Termination

14. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SAIRA ACAD regarding the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any affiliate or in connection with a merger, acquisition, or sale of assets.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, or acts of government.
